Welcome to Land Owl. By accessing or using our website, mobile application, and related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the Services.
These Terms constitute a legally binding agreement between you and Land Owl LLC ("Land Owl," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.
2. Description of Service
Land Owl is a property intelligence platform that provides access to:
- 160M+ parcel records nationwide with county-verified data
- Comprehensive zoning data and permitted use information
- Interactive mapping with 15+ data layers (infrastructure, environmental, political boundaries)
- Portfolio management tools (saved parcels, tags, notes, groups)
- Data export capabilities (CSV, Excel, PDF)
- AI-powered property analysis and insights
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.
3. User Accounts
3.1 Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
3.2 Account Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts. By creating an account, you represent and warrant that you meet these requirements.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
- Extended period of inactivity
You may cancel your account at any time through your account settings or by contacting support.
4. Subscription and Billing
4.1 Subscription Plans
Land Owl offers multiple subscription tiers with varying features and usage limits. Current plans include Free, Professional, and Enterprise tiers. Detailed pricing and features are available on our website.
4.2 Payment Terms
- Subscriptions are billed monthly or annually, as selected
- All fees are in U.S. dollars and non-refundable except as required by law
- You authorize us to charge your payment method on a recurring basis
- Price changes will be communicated 30 days in advance
- Failed payments may result in service suspension or termination
4.3 Free Trial
We may offer a 7-day free trial for new users. At the end of the trial, you must subscribe to continue accessing premium features.
4.4 Refund Policy
All subscription fees are non-refundable. By subscribing, you acknowledge that all payments are final and no refunds will be provided for partial billing periods, cancellations, or unused services.
4.5 Cancellation
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. You will retain access to paid features until that date. No partial refunds are provided for mid-cycle cancellations.
5. Acceptable Use Policy
You agree not to:
- Use the Services for any illegal purpose or in violation of any laws
- Violate the intellectual property rights of Land Owl or third parties
- Scrape, harvest, or systematically download data from the Services using automated tools
- Reverse engineer, decompile, or attempt to derive source code from the Services
- Interfere with or disrupt the Services or servers/networks connected to the Services
- Attempt to gain unauthorized access to any portion of the Services
- Upload viruses, malware, or other malicious code
- Impersonate any person or entity or misrepresent your affiliation
- Use the Services to send spam, unsolicited communications, or fraudulent content
- Resell, redistribute, or sublicense access to the Services without authorization
- Use the Services to build a competing product or service
6. Intellectual Property
6.1 Our Intellectual Property
The Services, including all content, features, functionality, software, code, designs, graphics, logos, and trademarks, are owned by Land Owl or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, subject to these Terms.
6.2 User-Generated Content
You retain ownership of any content you create using the Services (e.g., custom notes, tags, saved views). By using the Services, you grant us a worldwide, royalty-free license to store, display, and process your content solely to provide the Services.
6.3 Third-Party Data
Property data, zoning information, and map tiles are provided by third-party licensors (including MapTiler and other data providers). Use of this data is subject to their respective terms and conditions.
7. Data Accuracy and Disclaimer
IMPORTANT: Property data, zoning information, and other content provided through the Services are sourced from third parties (county assessors, data providers, etc.) and may contain errors, omissions, or outdated information.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee the accuracy, completeness, timeliness, or reliability of any data. You are solely responsible for verifying all information through official county records and consulting with qualified professionals (surveyors, attorneys, real estate agents, etc.) before making any decisions.
Land Owl is a research tool, not a substitute for professional due diligence.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAND OWL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
- DAMAGES ARISING FROM USE OF OR RELIANCE ON THE SERVICES OR THIRD-PARTY DATA
- ERRORS, INACCURACIES, OR OMISSIONS IN PROPERTY DATA, ZONING INFORMATION, OR OTHER CONTENT
- INTERRUPTIONS, DELAYS, OR UNAVAILABILITY OF THE SERVICES
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO LAND OWL IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Land Owl and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use or misuse of the Services
- Violation of these Terms or applicable laws
- Infringement of third-party rights
- Your reliance on data provided through the Services without proper verification
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
You agree to waive any right to a jury trial or to participate in a class action lawsuit.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Services. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
